Fitness Membership - Terms and Conditions

Acceptance of these Terms and Conditions constitutes a contract between you and sportscotland.

Your membership is conditional upon the adhering of these Terms and Conditions and all other rules and regulations made by us from time to time.

Who we are? These “Terms and Conditions” form the contract between you. (“the Member” or “you”) and us, The Scottish Sports Council Trust Company, a company incorporated in Scotland under the Companies Act 2006 with Registration Number SC137068 and having its registered address at The Doges, Templeton on the Green, 62 Templeton Street, Glasgow, G40 1DA (“sportscotland”, “we” or “us”).

The Trust Company is a trading company who are controlled by The Scottish Sports Council trading as ‘sportscotland,’ established by Royal Charter (RC000546) and having its Principal Office at The Doges, Templeton on the Green, 62 Templeton Street, Glasgow, G40 1DA. VAT Registration Number 592995276.

How we may contact you:    

If we have to contact you, we will do so by telephone or by writing to you at the email address you provided to us in your application. 

“Writing” includes emails. When we use the words “writing or written” in these terms, this includes emails. 

2.1.    A contract for Fitness Membership will come into existence between you and us, upon completion of the following elements :

  • Successful completion of the online member sign up, including:

    • completion of the direct debit instruction,

    • payment of pro rata monies due in advance,

    • Acceptance of the health statement

    •  Acceptance of these terms and conditions

  • Completion of an induction for junior members, this is optional for other membership types.

  • Attendance at reception between 08.00am to 10.00pm to:

    • Have your membership picture taken by a member of our team

    • Student Members only supply proof of student status.

3.1.    ‘Membership’ means your contractual relationship with us, which can be on various terms, offering services and benefits depending on the type held. You must be at least 14 years old to qualify for a Membership and to access fitness classes.

4.1. These services will commence on the date your application is accepted and shall continually remain in force unless either sportscotland or you terminate the contract using the provisions within sections 10 and 11, below.

4.2. ID is required to be supplied at reception upon completion of the online member sign up prior to confirmation of membership for the following membership categories :

4.3. Student: a valid form of student ID is required to be submitted at time of joining and again annually to confirm a valid student status.

4.4. Junior membership will be automatically moved on to a standard membership tariff from the date of their 18th birthday. Members will be contacted by email with 30 days notice in advance of this change.

5.1.  Access to the fitness suite is included for all membership types. Access times are published via the website and are non-contractual, access times are subject to change, with any permanent change advised with at least 30 days notice.

Off peak membership is restricted access during Monday to Friday 9am – 5pm and 12 – 8pm on Saturday and Sundays.

5.2. The fitness team are able to provide fitness programming for any new member. After the initial programme, ad hoc guidance for exercise technique and equipment usage can be provided, subject to availability of the fitness team.

Any medical conditions or injuries which may impact the type of exercises suggested should be highlighted during the programming session, where other alternatives or adaptations may be offered. In line with the health statement outlined in section 12, it is the members responsibility to satisfy themselves that they are suitably fit and healthy for any programmed exercises suggested by the fitness team and in event of doubt, should consult with their doctor in the first instance.

5.3. Residential use. As a residential sports training centre – group residential bookings take priority and we may require to temporarily suspend or restrict access to the fitness suite, either fully or partially, to accommodate group usage. There would be no reduction in membership charges as a result of limited access linked to group usage.

5.4. Any suspended access will be displayed within the fitness suite and the via the app, normally with seven days advance notice. It is the responsibility of the member to ensure they are aware of any restrictions.

5.5. On acceptance of your membership, all fitness members require to download the sportscotland Inverclyde app; this is used to permit access with a QR code reader or NFC enabled tag for all valid memberships.

6.1. Subject to your type of membership, we may also supply you with complimentary access to fitness classes. Off peak membership does not include complimentary class access and must book classes on a PAYG (Pay As You Go) basis.

6.2. Fitness classes can be booked by non-members and off-peak members up to seven days in advance on a Pay As You Go basis, with full payment taken at time of booking.

6.3. If you have pre-booked a fitness class and are unable to attend, you must cancel, either via the app, website or by calling the centre to advise of your non-attendance. Persistent non-attendance of fitness classes may result in removal of advance booking ability for a limited time.

6.4. Cancellations made more than 24 hours in advance of the class start time may be eligible for a refund, where applicable for PAYG or off-peak members. Refund requests can be made by contacting our reception team. Cancellations made less than 24 hours in advance of the class start time are non-refundable.

6.5. A fitness class schedule is available via the app and website. Class schedule is subject to change or cancellation, with booking available on a first come first served basis. We reserve the right to amend, alter or withdraw any fitness class without notice should it be deemed necessary due to operational reasons. Classes with no bookings will be cancelled 15 minutes prior to the proposed start time.

6.6. Participants are asked to arrive at least 5 minutes before the class start times, dressed and ready for participation. Baggage and jackets should be stored in lockers prior to class attendance.

6.7. Lates arrivals may not be permitted into the class for safety reasons. No refunds will be due in such circumstances.

7.1. Membership fees are VAT exempt, current pricing is available on our website.

7.2. All new members will require to pay a pro rata joining fee as part of the online member sign up.

7.3. Thereafter payment of Membership fees are due monthly, in advance and are payable by direct debit. sportscotland aim to take membership payments on the 1st of each month. Where the 1st of a month falls on a non-banking day, payment will be taken on the next available day after. The direct debit date cannot be changed.

 

8.1.    If you wish to make a change to your Membership, changes must be requested in writing. Please contact our customer services team at inverclyde.enquiries@sportscotland.org.uk. We will let you know if the change is possible and;

•    about any changes to the services provided to you under your membership. 
•    about any changes to the price of your membership.
•    the effective date of any changes to services provided to you.
•    the effective date of any price changes to your direct debit payment; and
•    anything else which would be necessary as a result of your requested change.

9.1.    Minor changes. We may change how we deliver your Membership:

  • to reflect changes in relevant laws and regulatory requirements which may include changing how we handle and process your personal data or payments.

  • to implement minor technical adjustments and improvements, for example to address a security threat or health and safety issue.

  • to maintain and repair the fitness suite, studios, any equipment, or the building.

  • to make improvements to our facilities.

These changes are not expected to significantly affect your use of the services provided to you. There would be no reduction in membership pricing as a result of a minor change. 

8.2.    More significant changes. In addition, we may make more significant changes to these terms or the services. Changes may include but are not limited to.

a)    Membership price.
b)    Opening Hours; and
c)    Types of Membership available. 

sportscotland will provide you with a minimum of 30 days’ notice of any significant changes to your membership. Communication of any changes will be made in writing. You may then contact us to end the contract before the changes take effect. For further details on cancelling your membership please refer to section 11.

10.1. We may cancel or suspend a Membership in the following instances:

  • if there is a serious or repeated breach of these Terms and Conditions or our Fitness Code of Conduct.

  •  If the Membership direct debit payment is not paid in full at it’s due date; or

  • If you provide us with details which we know to be false when applying for Membership and the false declaration would have reasonably affected our decision to grant you Membership.

10.2. We reserve the right to cancel or suspend any Membership and retain all money which has been paid to sportscotland under this agreement to cover any reasonable costs sportscotland has incurred as a result of the grounds for cancellation.

Grounds for cancellation or suspension include but are not limited to issues relating to safety, clear evidence that the member is abusing the service, allowing others to abuse it, or otherwise behaving in a way that involves serious risk to our interests or those of other members.

10.3. We are not responsible for delays outside our control. If our performance of the services is affected by an event outside our control, we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this, we will not be liable for delays caused by the event but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any services you have paid for but not received.

Delays outside our control may include but are not limited to:

  • Adverse weather.

  • Road traffic accidents restricting access.

  • Equipment failure.

  • Staff absence.

11.1. You may, at any time, terminate your membership by cancelling your direct debit directly with your bank. Direct debit cancellation is required three working days prior to the end of a calendar month to ensure the next payment is not taken.

11.2. Please also advise us of your cancellation in writing either by, emailing us at inverclyde.enquiries@sportscotland.org.uk or by completing a cancellation form which is available from reception. It is the member’s responsibility to ensure cancellation of direct debit, and the centre will not issue refunds in the event of members omitting to cancel their direct debit prior to the next collection date.

11.3. All members will retain access to services related to their membership for the remainder of the calendar month following their final direct debit payment.

12.1. You are advised not to undertake physical activities for which you might be medically unfit, and we will not be responsible for any harm which may come to you as a result of your physical capabilities. If you have any reasonable reservations as to your physical condition you are advised to have a medical check-up by a qualified doctor before embarking on any exercise.

13.1. Access to the fitness suite is managed via the sportscotland Inverclyde app, with the account linked to the member phone. Each member requires to scan the applicable QR code or tap via NFC enabled technology at each visit. Enabling access for others is prohibited and may result in membership cessation. Any member changing to another handset will require a reset of their account with reception providing assistance.

13.2. It is your responsibility to ensure that you fully understand the exact nature of each exercise you undertake, the risks involved, skill levels required, and the equipment needed for your safe participation. You should never participate in any fitness activity, either in the fitness suite or in a class, where you are unsure of any of the above aspects. If unsure, please speak to a member of staff.

13.3. At no time should fitness members proceed to move, assemble or dismantle any centre equipment. Any fault or concerns noted about the equipment or facility, should be raised directly within the centre team.

13.4. Fitness members must follow all applicable Health and Safety notices displayed at the Centre. You must comply with any fire safety signage or signaling, ensuring you evacuate the building promptly should the fire alarm sound. (Please inform a member of staff at the time of joining if you require assistance to evacuate the building when joining.)

13.5. In the event of any accident, incident or emergency please report this either in person or by telephone to the Centre’s reception immediately. An incident or accident form will require completion.

13.6. Centre staff may have requirement to access the facility in use at any time for health & safety or maintenance purposes. Every effort will be made to minimise disruption.

13.7. You are expected to conduct yourself in a safe and appropriate way having due regard for fellow users and the Fitness Code of Conduct.

14.1.         The Centre accepts no liability for any loss or damage occurring from the use of the Facilities, Activities and Services or for loss of, or damage to, property or items left at the Centre. The Centre will not be held liable or be required to pay compensation howsoever incurred as a direct or indirect result of any cancellation including but not limited to any third-party loss or liability incurred. Nothing in these Terms and Conditions shall exclude or limit sportscotland’s liability for death or personal injury caused by sportscotland’s negligence, the negligence of its employees or agents or for fraudulent misrepresentation or any other liability that cannot be excluded or limited by applicable law.

15.2. We will use the personal information you provide to us to:

a) Provide the services for the performance of this contract.

b) Process your payment for such services; and

c) If you agreed to this during the application process, to inform you about similar products and services that we provide, but you may stop receiving these communications at any time by contacting us.

15.3. We will only give your personal information to third parties where the law either requires or allows us to do so.

16.1. Nobody else has any rights under this contract. This contract is between you and us. No other person shall have any rights to enforce any of its terms.

16.2. If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

16.3. These terms are governed by Scottish Law, and you can bring legal proceedings in respect of the services in Scottish courts.

16.4. Should you be dissatisfied with any aspect of your membership or services received, please contact the Guest Support Manager in the first instance to discuss. If you remain dissatisfied and wish to raise a complaint, please consult our Complaints Policy for further information:

17.1. Junior memberships are the applicable membership category for young people aged 14 – 17 years. Parental consent is required for any junior membership.

17.2. All junior members require to complete an in-person induction prior to commencement of any fitness suite access or class booking.

17.3. By accepting these terms and conditions, you commit to reinforcing the fitness suite code of conduct with your junior member. Membership may be cancelled with immediate effect, should the code of conduct be breached or any other issue which impacts the safety or wellbeing of members and staff.

Equipment usage

  • Use equipment in a safe manner for its intended purpose, please ask the fitness team if you require any advice.

  • Lifting & dropping of heavy weights is permitted in zone 2 only.

  • Clean equipment after each use & return to storage position, where applicable.

  • Only equipment supplied within the fitness suite is permitted for use.

Phones & Media

  • No phone calls or media on speaker in the fitness suite.

  • No filming, image or audio capture of others is permitted. Members are subject to challenge over any phone use which is of concern to staff or other members.

  • Members should not share content online including social media channels that could identify another member or user group.

Member conduct

  • Show consideration for other users and staff refraining from any behaviour which is considered aggressive, abusive, intimidating, anti-social or threatening manner or in a way that might cause distress to others.

  • Be considerate towards all staff and cooperate with their instructions.

  • Not conduct any personal training business or group workouts.

  • Don’t engage in any exercise activity that may be potentially harmful to you or others.

Clothing & personal belongings

  • Wear suitable clothing and footwear for the activities to be undertaken. Outdoor shoes are not permitted.

  • No bags, jackets or other personal belongings to be taken into the fitness suite, use lockers provided.

  • Other than sport water bottles, no other food or drink is permitted within the fitness suite or studios. Water fountains are for bottle use only.
