Fitness Membership - Terms and Conditions

Acceptance of these Terms and Conditions constitutes a contract between you and sportscotland. 

Your membership is conditional upon the adhering of these Terms and Conditions and all other rules and regulations made by us from time to time.

Who we are? These “Terms and Conditions” form the contract between you. (“the Member” or “you”) and us, The Scottish Sports Council Trust Company, a company incorporated in Scotland under the Companies Act 2006 with Registration Number SC137068 and having its registered address at The Doges, Templeton on the Green, 62 Templeton Street, Glasgow, G40 1DA (“sportscotland”, “we” or “us”).

The Trust Company is a trading company who are controlled by The Scottish Sports Council trading as ‘sportscotland,’ established by Royal Charter (RC000546) and having its Principal Office at The Doges, Templeton on the Green, 62 Templeton Street, Glasgow, G40 1DA. VAT Registration Number 592995276.

How we may contact you:    

If we have to contact you, we will do so by telephone or by writing to you at the email address you provided to us in your application. 
“Writing” includes emails. When we use the words “writing or written” in these terms, this includes emails. 

2.1.    A contract for Fitness Membership will come into existence between you and us, upon completion of the following elements :

  • Receipt of a completed application form with signed acknowledgement of these terms and conditions, from each joining member. Parent/guardian is required to complete for junior membership applications.
  • Receipt of a completed pre-exercise questionnaire (PAR-Q) which has been signed off by a fitness instructor.
  • Payment of your joining fee in full, from each joining member.
  • Receipt of a completed direct debit form.
  • Completion of an induction – mandatory for junior members, optional for other membership types. 

3.1.    ‘Membership’ means your contractual relationship with us, which can be on various terms, offering services and benefits depending on the type held. You must be at least 14 years old to qualify for a Membership and to access fitness classes.

4.1.    These services will commence on the date your application is accepted and shall continually remain in force unless either sportscotland or you terminate the contract using the provisions within paragraphs 10 and 11 below. You can give one month’s notice to terminate your membership at any time and there will be no financial sanction for cancellation.

5.1.    On acceptance of your membership, all fitness members will be supplied with access to the fitness suite via a coded access band. 

5.2.    Subject to your type of membership we may also supply to you with free access to fitness classes. In such circumstances 7 days advance booking for classes is permitted. 

5.3.    Fitness classes can be booked by non members and off peak members up to seven days in advance on a Pay As You Go basis, with full payment taken at time of booking.

5.4.    A fitness class schedule is published on the website. Class schedule is subject to change or cancellation, with booking available on a first come first served basis. We reserve the right to amend, alter or withdraw any activity or fitness class without notice should it be necessary for business activity, due to unforeseen circumstances, or low numbers. 

5.5.    Residential use. As a residential sports training centre – group residential bookings take priority and we may require to temporarily suspend access or restrict access to certain areas within the fitness suite.

5.6.    Any suspended access will be displayed on fitness suite screens and on our website a minimum of 7 days in advance. It is the responsibility of the member to ensure they are aware of any suspended access periods affecting fitness facilities. 

These changes are not expected to significantly affect your use of the services provided to you. There would be no reduction in membership pricing as a result of residential use. 

6.1.    Membership fees are VAT exempt, current pricing is available on our website.  

6.2.    On acceptance of your application, you will be required to pay your joining fee in full. 

6.3.    Thereafter payment of Membership fees are due monthly, in advance and are payable by direct debit. You must complete a Direct Debit form as part of the application process. sportscotland aim to take membership payments on the 1st of each month. Where the 1st of a month falls on a non-banking day, payment will be taken on the next available day after. This date cannot be changed. 

6.4.    For Joint Memberships a single direct debit payment is required to pay for both members, however you may live at separate addresses. 

 

7.1.    If you wish to make a change to your Membership, changes must be requested in writing. Please contact our customer services team at inverclyde.enquiries@sportscotland.org.uk. We will let you know if the change is possible and;

•    about any changes to the services provided to you under your membership. 
•    about any changes to the price of your membership.
•    the effective date of any changes to services provided to you.
•    the effective date of any price changes to your direct debit payment; and
•    anything else which would be necessary as a result of your requested change.

8.1.    Minor changes. We may change how we deliver your Membership:

  • to reflect changes in relevant laws and regulatory requirements which may include changing how we handle and process your personal data or payments.
  • to implement minor technical adjustments and improvements, for example to address a security threat or health and safety issue.
  • to maintain and repair the fitness suite, studios, any equipment, or the building.
  • to make improvements to our facilities.

These changes are not expected to significantly affect your use of the services provided to you. There would be no reduction in membership pricing as a result of a minor change. 

8.2.    More significant changes. In addition, we may make more significant changes to these terms or the services. Changes may include but are not limited to.

a)    Membership price.
b)    Opening Hours; and
c)    Types of Membership available. 

sportscotland will provide you with a minimum of 30 days’ notice of any significant changes to your membership. Communication of any changes will be made in writing. You may then contact us to end the contract before the changes take effect. For further details on cancelling your membership please refer to paragraph 11.

9.1.    We may cancel or suspend a Membership in the following instances:

  • if there is a serious or repeated breach of these Terms and Conditions or our Fitness Code of Conduct.
  • If the Membership direct debit payment is not paid in full at it’s due date; or
  • if you provide us with details which we know to be false when applying for Membership and the false declaration would have reasonably affected our decision to grant you Membership.

9.2.    We reserve the right to cancel or suspend any Membership and retain all money which has been paid to sportscotland under this agreement to cover any reasonable costs sportscotland has incurred as a result of the grounds for cancellation.

  • Grounds for cancellation or suspension include but are not limited to issues relating to safety, clear evidence that the member is abusing the service, allowing others to abuse it, or otherwise behaving in a way that involves serious risk to our interests or those of other members.

9.3.    We are not responsible for delays outside our control. If our performance of the services is affected by an event outside our control, we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any services you have paid for but not received.

Delays outside our control may include but are not limited to:

  • Adverse weather
  • Road traffic accidents restricting access.
  • Equipment failure.
  • Staff absence.

10.1.    You may, at any time, terminate your membership by cancelling your direct debit directly with your bank. Direct debit cancellation is required three days prior to the end of a calendar month to ensure the next payment is not taken.

10.2.    Please also advise us of your cancellation in writing either by, emailing us at inverclyde.enquiries@sportscotland.org.uk or by completing a cancellation form which is available from reception.     It is the members responsibility to ensure cancellation of direct debit and the centre will not issue refunds in event of direct debit not cancelled prior to collection date.

10.3.    All members will retain access to services related to their membership for the remainder of the calendar month following their final direct debit payment. Gymnastics : On cancellation membership will immediately cease with the child/young person removed from class lists. 

10.4.    If you are cancelling a Joint Membership you must inform other member within your Joint Membership. If the other member wish to continue a membership,  they must contact us to discuss. 

10.5.    To cancel a fitness class, if you have pre-booked a fitness class and are unable to attend you must call prior to the commencement of the fitness class to advise of your non-attendance. 

10.6.    Persistent non-attendance of fitness classes will result in you not being permitted to advance book. 

11.1.    You are advised not to undertake strenuous physical activities for which you might be medically unfit, and we will not be in any way responsible for any harm which may come to you as a result of your physical capabilities. If you have any reasonable reservations as to your physical condition you are advised to have a medical check-up by a qualified doctor before embarking on any exercise.   

11.2.    Membership bands must be worn at all times, these require to be scanned  on arrival at the fitness gate. If you forget your band, you must inform a member of the fitness team and use the sign in sheet prior to working out. If you lose your band, you may purchase a replacement at a cost of £5 from reception. Sharing of bands to other members as well as permitting access to non members is strictly prohibited and will result in termination or temporary cessation of membership.

11.3.    It is your responsibility to ensure that you fully understand the exact nature of each activity you undertake, the risks involved, skill levels required, and the equipment needed for your safe participation. You should never participate in an activity where you are unsure of any of the above aspects. If unsure, please speak to a member of staff.

11.4.    At no time should fitness members proceed to move, assemble or dismantle any centre equipment. Any fault or concerns noted about the equipment or facility in general, should be raised directly within the centre team. 

11.5.    Fitness members must follow all applicable Health and Safety notices displayed at the Centre. 

11.6.    In the event of any incident or emergency please report this either in person or by telephone to the Centre’s reception immediately.   An incident form will require to be completed.

11.7.    Centre staff may have requirement to access the facility in use at any time for health & safety or maintenance purposes. Every effort will be made to minimise disruption.

11.8.    You are expected to conduct yourself in a safe and appropriate way having due regard for fellow users and the Fitness Code of Conduct.

12.2.    We will use the personal information you provide to us to: 

a)    Provide the services for the performance of this contract.
b)    Process your payment for such services; and
c)    If you agreed to this during the application process, to inform you about similar products and services that we provide, but you may stop receiving these communications at any time by contacting us.

12.3.    We will only give your personal information to third parties where the law either requires or allows us to do so.

12.4.    For Photography and Videography, please see the separate Consent Form detailing how we process personal data.

13.1.    Nobody else has any rights under this contract. This contract is between you and us. No other person shall have any rights to enforce any of its terms.

13.2.    If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

13.3.    Which laws apply to this contract and where you may bring legal proceedings. These terms are governed by Scottish Law, and you can bring legal proceedings in respect of the services in Scottish courts. 

13.4.    Should you be dissatisfied with any aspect of your membership or services received, please contact the Guest Support Manager in the first instance to discuss. If you remain dissatisfied, please consult our Complaints Policy for further information: - 

14.1.    I have read and understood these Terms and Conditions including Fitness Code of Conduct and as a Member I agree to adhere to them. 

  • Members should use their own personal fitness suite band for access to the fitness suite. Sharing of member bands is strictly prohibited and may result in membership cancellation.  Please attend reception if you forget your band, replacement bands can be purchased during reception opening hours at a cost of £5 per band.
  • No bags, jackets or other personal belongings to be taken into the fitness suite, use lockers provided.  Own padlock required.
  • Clean equipment after each use & return to storage position, where applicable.
  • Only equipment supplied within the fitness suite is permitted for use.
  • Not conduct any personal training business or group workouts with other members.
  • No phone calls or media on speaker in the fitness suite.
  • No filming, image  or audio capture of others is permitted. Members are subject to challenge over any phone use which is of concern to staff or other members. 
  • Members should not share content online including social media channels that could identify another member or user group.   
  • Wear suitable clothing and footwear for the activities to be undertaken. Outdoor shoes are not permitted.
  • Use equipment in a safe manner for its intended purpose, please ask the fitness team if you require any advice.   
  • Lifting & dropping of heavy weights is permitted in zone 2 only.
  • Not engage in any exercise activity that may be potentially harmful to you or others.
  • Show consideration for other users and staff refraining from any behaviour which is considered aggressive, abusive, intimidating, anti-social or threatening manner or in a way that might cause distress to others.
  • Be considerate towards all staff and cooperate with their instructions.
  • Other than sport water bottles, no other food or drink is permitted within the fitness suite or studios.  Water fountains are for bottle use only.
